I just received a shiny Smither's Protector, but I haven't got a clue what's its function. It looks like an ordinary pickaxe, but it says it's an axe when double clicked. Can't mine with it, that's for sure.

Yes, a skill ball can take you to 120 if you use a powerscroll. And yes, a skill ball can be used at any time, I used mine after playing two months.
