Well a somewhat simpler solution would be to ask, "I'm also thinking of a number it's either 1 or 2. Is your number larger than mine?".
If the original number is 1, then the answer would be "No".
If the original number is 2, then the answer would be "I don't know."
If the original number is 3, then the answer would be "Yes".
Dutch, as for your solution, I'm sorry but it wouldn't work. If you asked if they're thinking of an odd number, they will say "yes" whether they have 1 or 3 in their mind. Now, if you're lucky they will say "no" and you will know it's 2. But if they say yes, you still don't exactly know if it's 1 or 3.
